  • TERMS AND CONDITIONS
    • ENTIRE AGREEMENT: This agreement contains the entire understanding between the parties, Amy B Photography (ABP) and the client. It supersedes all prior and simultaneous agreements between the parties.
    • RESERVATION: Upon your ticking of the check box below and receipt of the reservation deposit (or rearrangement fee) ABP will reserve the time and date agreed and will not make other reservations for that time and date. For this reason the reservation deposit of 25% of the total balance is non refundable, even if the date is rearranged or the wedding cancelled by the client for any reason including acts of God, fire, strike and extreme weather. The reservation deposit (or rearrangement fee) is to be paid at the time of checking the box below.
    • REARRANGEMENT: The client agrees to notify ABP as soon as is practically possible that a rearranged date is being considered regardless of whether or not a rearranged date(s) has been determined by the client. In most circumstances, ABP will try to accommodate any rearranged date(s) requested by the client, though cannot guarantee availability. ABP reserves the right to decline any rearranged date for whatever reason. In the event that a rearranged date is mutually agreed between the parties a rearrangement fee of 25% of the total balance is due for payment immediately in order to secure the rearranged date. This rearrangement fee will be deducted from the remaining outstanding balance that is due in full no later than eight weeks prior to the rearranged date. If a rearranged date is agreed by the parties but travel and/or accommodation expense already incurred by ABP is not transferred to the rearranged date then the client agrees to reimburse ABP within 14 days of agreeing to the rearranged date. If a rearranged date cannot be agreed by the parties and travel and/or accommodation expense was not separately quoted then any travel and/or accommodation expense incurred in relation to the agreement will be first satisfied by ABP for up to the value of the reservation deposit. Any excess travel and/or accommodation expense incurred by ABP over and above the value of the reservation deposit will be satisfied by further payment by the client to ABP within 14 days of the notification that a rearranged date cannot be agreed. If a rearranged date cannot be agreed by the parties and travel and/or accommodation expense was separately quoted then any travel and/or accommodation expense will be satisfied by further payment by the client to ABP within 14 days of the notification that a rearranged date cannot be agreed. In these circumstances ABP will provide confirmation of the expenses incurred to the client by way of receipts or booking confirmations as applicable. For the avoidance of doubt rearrangements due to COVID related disruption will not be treated any differently to any other reason for rearrangement. ABP will endeavour to agree to rearranged dates on a first come first served basis but cannot give any guarantees to this effect. Rearrangement must be confirmed by all parties by no later than eight weeks prior to the original event date and provided that the rearrangement fee is received by ABP in full before this time.
    • PRE EVENT CONSULTATION: The parties agree to a pre event consultation in person, by telephone or via Skype before the event date in order to finalise the actual shooting times, locations and the clients request list (in writing) for specific photographs. The client will be solely responsible for identifying people of whom specific photographs are desired. ABP will not be held accountable for not photographing desired people if there is no one to assist in identifying the guests or gathering people for the photograph(s). In most cases the couple must agree to a period of between 20-30 minutes directly after the wedding for group shots that cannot be obtained otherwise. If this time frame is not permitted for any reason by the client ABP shall not be held liable for failure to take desired photograph(s).
    • HOUSE RULES: ABP is limited by the guidelines of the ceremony official and/or reception site management. The client agrees to accept the technical results of the guidelines imposition on the photography.
    • DIGITAL NEGATIVES, PRINTS AND COPYRIGHT: The photographs, digital files, prints and any other material produced by ABP are protected by Copyright law (all rights reserved) and may not be reproduced in any manner by any of the couple's other wedding suppliers. A USB of the photographs will be supplied within the chosen package whereby the client, in this circumstance only, can reproduce the images as and when they see fit.
    • MODEL RELEASE: The client hereby grants to ABP the unrestricted right to use and publish photographs of the client and photographs in which the client and other guests may be included. Said photographs may be used for editorial, trade, advertising and/or any other purpose and in any other manner or medium that ABP sees fit.
    • EXCLUSIVITY/GUEST PHOTOGRAPHY: Upon the agreement of this contract by checking the box below, it is understood that ABP will be the only wedding photographer. The client acknowledges that they are responsible for notifying the guests that guest photography is limited at the time that the professional photographer is working. Because of time constraints and the need for subjects to give full attention to the professional photographer, guest photography cannot be permitted until the photographer allows it after each group shot.
    • FILE FORMAT: Under no circumstances does ABP supply any of the RAW files to the client. Up to 450 high resolution JPG’s (amount depending on the chosen package) will be supplied and these will document a sufficient cross section from each part of the wedding day. The high resolution JPG’s will ensure an excellent print quality.
    • COMPLETION SCHEDULE: Contact will be required with the client eight weeks after the date of the wedding to preview the album design and the photographs. Depending on the package chosen, the client will view up to four hundred and fifty images taken on the day. The final delivery of the album will take place approximately a further four weeks after the files have been sent to print. Upon signing this contract, the client understands that these time spans are given as a guide only and may vary depending on any unforeseen circumstances.
    • PAYMENTS: The client agrees that a 25% reservation deposit is required at the time of ticking the check box below to secure the booking, and 100% of the remaining outstanding balance is due no later than eight weeks prior to the event date. The client agrees that if the remaining outstanding balance has not been paid by this date ABP reserves the right to cancel their services with no liability to ABP and loss of reservation deposit by the client. For all payment information relating to the rearrangement fee please refer to the third point above titled 'REARRANGEMENT'.
    • LIMIT OF LIABILITY: In the unlikely event of a medical, natural or other emergency it may be necessary for ABP to retain the services of a different photographer. In this instance ABP will make every reasonable effort to secure a replacement photographer. If the instance should occur and a suitable replacement photographer is not found, responsibility and liability is limited to the return of all payments received for the event. ABP takes the upmost care with respect to exposure, transportation and processing of photographs including using professional grade equipment at all times. However, in the unlikely event that photographs are stolen, lost or destroyed for any reasons within or beyond the control of ABP it will result in the return of all payments received for the event only.
    • PRINTED ALBUM: Once page layout and design has been confirmed, sent to print and delivered, ABP is not liable to make any further alterations to the finished product once printed. Any alterations to be made can only occur prior to sending the album design off for printing externally.
    • THIRD PARTY USE: In some cases, ABP will submit images to wedding magazines and mainstream wedding blogs. If accepted, the couple is often required to fill out a small questionnaire sent from the magazine/blog and then a small feature will be written up and featured either in print or online. This helps future couples to plan their big day whilst also raising ABP’s business profile.
    • SEVERABILITY: If any provision of this agreement is held to be invalid or unenforceable under UK law the validity of this agreement as a whole shall not be affected, and the other provisions of this agreement shall remain in full force and effect.
